Shoot. I have been on Ebay since 1999. Perfect rating, until today. October 8th I sold a used Blackberry Storm in perfect condition on Ebay to a guy with only a 2 feedback rating, both positive.

I included free shipping, the wall charger, a car charger and I put the phone in a new leather case then wrapped all that in bubble wrap. I was going to send it out on a Saturday, but the guy emails me and says he needs it desperately and could I ship it that same day. Since I can't drive as I just had surgery and my left lower leg/foot is in a huge cast, I ask my wife if she could go to the shipping place and ship it. She says yes, and we ship it the same day! I mean, we shipped it no more than an hour after he sent the payment via Paypal. We shipped it October 8th and he got it October 12th (due to the Monday holiday.)

Nine days later he says it doesn't work. Sigh. I get up this morning and log on to my email, and there sit two emails from the guy saying the screen gets "stuck" and you can't type on it at all. This is after him having it for over a week. To top it all off, yesterday, BEFORE contacting me, he left me negative feedback.

I know, I know, it's only a website and the feedback doesn't really mean much, but it's the principal of the thing. He could have contacted me about it and maybe we could have worked something out. The ad specifically said no returns.

I wrote him an angry email telling I believe he broke it, and that since he left me negative feedback before contacting me and the ad said 'no returns' I feel I've fulfilled my ethical and moral duty. I didn't even mention the extras I sent and going out of our way to ship it.

I can attest to, as well as 4 others, that it was in perfect condition when I sent it to him. The pictures on the Ebay ad show it working fine.

But now I sit here waiting for him to open a "resolution" via Ebay and Paypal, and most of the times the 'seller' gets screwed.

Two things stick out as I read your entry, Chip.

1) He needed it right away and it was DELIVERED on the 12th.
2) He has a problem with it, on the 21st.

I have never had an Ebay dealing---but if I were answering a customer complaint--I would point out that this certainly implies he has been USING it all week. So, if the screen sticks NOW, it did NOT stick when it arrived to him. "Stuff breaks, but the stuff I sold you was in good working order until it broke, while in YOUR possession."

I believe Ebay should agree, over a week of use later is not indicative of you selling him a faulty product. More likely, he treated it poorly and broke it.

I would think ebay would see it that way, as well---but again, I have NO experience with them.

Isn't there a way to get the neg FB removed? If you plead your case to Ebay, and tell them: 1. that the newbee gave you the neg without even contacting you, and 2. you'd have offered to take it back if he had, they might remove the neg FB... ?

It's probably too late for you to give him neg FB? I'd sure warn people in your note under the dummy's neg rating on the feedback page.

Ebay has a new policy that sellers cannot leave negative feedback for buyers. I had left him a positive because he paid so fast, and it was almost two weeks ago. I did go back on and comment on that feedback though.

God must be watching over you if you have gone over 11 years on eBay with no problems....

If the item specifically says NO RETURNS than you have a chance of winning a resolution dispute since won't be claiming that the item didn't arrive. It is a Blackberry and you described a Blackberry. He had it 9 days before telling you it didn't work so you have a case that it worked when he got it and he broke it.

However, eBay is notorious for resolving disputes in the buyer's favor...they tell us sellers that that is a good thing. (It's not, deciding them fairly based on what happened would be, and of course eBay says they do that --- but they don't.)

It could be worse, it could be an international shipment where the buyer initiates a dispute before you can even send a customs inquiry and eBay decides to refund to the buyer, then the customs inquiry comes back saying that the item was delivered....eBay then say's sorry we can't help you.

I am leaving eBay at the end of the year.
 
sorry for the problems, I have dealt with Ebay a little and I like it as a buyer but hate it as a seller. hopefully things will go better
 
This just got a bit stranger. He opened an Ebay resolution case on this item, then within 2 minutes closed it as resolved. So, I guess I'm in the clear, maybe. :confused:
 
I would make complaint to ebay to have that negative removed. with all that commerce you have brought I think they will remove it.
 
Tell us the location we can always send Mugsy to talk to him...LOL I think if you petition Ebay you can get he negitive resolved if not it isnt a show stopper. I am sure there are people out there just waiting for the chance to mess up perfect feedback for no good reason.....Just look at it as if it was your sacrifice for him to feel a little better about himself that day and all it cost you was a comment. This buyer has much bigger issues in his life.
 
Not that I don't think that the negative feedback should be removed (because I do), but it isn't as bad, in the long run, as it used to be. Years ago, ALL your feedback was combined into a final score; one bad mark and your 100% rating was gone forever. Now feedback "ages out". (Check eBay's policies for the details.) At some point this creep's venom will fall to the wayside. Maybe by then he'll have a phone that works, and will call to apologize. :rolleyes: Hope springs eternal! :wink:

Check your PayPal and make sure eBay did not "resolve" it by automatically refunding payment. DAMHIKT :mad:

Also, do me a favor. PM the buyers eBay userID to me, so I can block him from bidding on any of my listings. :eek:
 
That's the problem with Feebay. Years ago they actually cared about their sellers. Now they do everything they possible can to give the 'buyers' the opportunity to screw the seller at any time. I stopped using Ebay as soon as they removed the ability for sellers to leave negative feedback.
 
Seller can't remove

As I understand it, the only way a seller can get negative feedback removed is to get the buyer to change it. I have had that done. eBay will almost never remove negative feedback for any reason.

But the upside is that other than a matter of personal price 100% positive feedback is not really a plus anymore. eBay has made it so easy for buyers to get a refund that they seldom even look. Why do you think eBay does not allow payment by "check or money order" anymore. Two reasons....they make money (from the seller of course) on paypal payment and they have control of the seller's money and can force the seller to make refunds if they decide a case in favor of the buyer...which they do about 95% of the time whether the seller is at fault or not.

We used to do a fair amount of business on ebay but don't mess with it too much anymore due to the ever increasing fees. We maintain a small ebay store inventory to help with getting our name out there and a few occasional auction items. The items we sell there aren't big money makers after listing fees, final valuation fees and of course, PayPal fees.
 
After I relented yesterday and said send it back and I'll give you a refund, didn't hear anything back, until this morning, and this is what I got:

2 things.... 1) you were a buyer not a seller and 2) seller's can't leave negative or neutral feedback for buyers anymore.
 
Ok, I admit that today I did some snooping. Use his name and address that I shipped the phone to I was able to find a Myspace page and his twitter page. He is a 16 or 17 year old high school kid. I went to his twitter page and in big bold letters is said

VERIZON JUST GAVE ME A BRAND NEW STORM 2


I sold him a Storm. He must have pulled the scam off.
 
Morals who needs them, cant scam the seller scam the next guy, Lets not take responsibilty for our actions. Is he allowed to buy on ebay Isnt he supposed to be 18? minimum?
 
I thought you had to be 18, but I'm not sure.

I know he paid me through his mom's account, so I guess I could talk to his parents about this whole incident.
 
You could talk to his parents but my experiance tells me that he probably got his attitude from them.
